چکیده: بافت فرسوده، یکی از معضلات بزرگ امروز کشور است. احتمال بروز هرچه بیشتر آسیب‌های اجتماعی در بافت‌های فرسوده از یک طرف و موضوع حوادث غیرمترقبه و نبود خدمت‌رسانی از سوی دیگر و همچنین لزوم تغییر سیمای شهر به شادابی و پویایی، از مشکلات بافت‌های فرسوده محسوب می‌شوند. از اینرو، ضرورت احیا و بهسازی این مناطق مشهود است. شهر سمنان، به دلیل قدمت اجتماعی، تاریخی و فرهنگی دارای بخش وسیعی در بافت فرسوده می باشد. یکی از چالش های بزرگ امروزه شهرها، مدرنیته کردن آنها می باشد، که این مساله نباید خللی در محدوده تاریخی شهرها ایجاد کند. با توجه به شرایط خاص این نواحی، دانستن و رعایت نکات حقوقی از جمله مواردی است که در شرایط مختلف این محدوده با آن مواجه خواهیم بود. در این مقاله به برخی مشكلات و راهکارهای حقوقی آن در محدوده بافت فرسوده و تاریخی شهر سمنان اشاره خواهیم نمود.

Abstract: Worn texture is one of the biggest problems of the country today. On the one hand, the possibility of more social damage in dilapidated structures and the issue of unexpected incidents and lack of service on the other hand, as well as the need to change the face of the city to freshness and dynamism, are among the problems of dilapidated structures.
Therefore, the need to restore and improve these areas is evident. The city of Semnan, due to its social, historical and cultural history, has a large part in worn-out fabric. One of the big challenges of cities today is to modernize them, which should not create a problem in the historical boundaries of cities.
According to the special conditions of these areas, knowing and observing legal points is one of the things that we will face in different conditions of this area. In this article, we will mention some legal problems and solutions in the context of the worn-out and historical context of Semnan city.
